This document is intended to be an Official Complaint of political corruption, criminal activity, betrayal of public trust and deceit put forth at numerous public meetings. A copy will be sent to the FBI, Alabama Attorney General and the District Attorney for Baldwin County. The complaint is intended to become an official notice to the general public of the continued corrupt activities of Fairhope Mayor Tim Kant.

No notice will be sent to Al.com as they have perpetuated the crime. Al.com has written about this ongoing story. Trouble is the fluff stories lack any investigative reporting, any constructive criticism voiced by the general public, omitting critical informational facts; this has perpetuated the criminal activity to the situation we find ourselves in today. Omitted in their stories related to the triangle lawsuit is the fact that the legal settlement was just that, not the purchase of a park. They also coincidentally failed to mention that Fly Creek is full of red clay and has completely lost its channel due to sediment deposited during Publix shopping center construction.

No notice will be given to the Alabama Ethics Commission as they are equally guilty, ignoring complaints for years about criminal and unethical behavior in Fairhope. The commission’s reputation, or shall I say lack of reputation, has demonstrated a pattern of behavior that shoots the messenger and ignores the complaint.

Mayor Tim Kant is the architect of the fraud, he is responsible for the deceit and the political dirty tricks that I will outline, however any city employee or public official who backs this obvious fraud should be held accountable.

Please bear with me as this will be a bit long, however you need to understand the magnitude of the conspiracy and level of deceit Mayor Kant has demonstrated. Let me make it perfectly clear that Publix had nothing to do with it; fact is they also have been duped.

The preliminary and final plat to add to the size and scope of their PUD is scheduled for a hearing Jan.5. The notices to the public are dated Dec. 5; however the posted notice on the site was only posted days before Christmas. No mention of construction of 275 apartments and 18 townhouses has been made available to the general public. Only the existing, problematic detention pond will facilitate approximately 300 new residential units. No traffic study for the expected additional 500 cars has been done, no environmental study related to the damage already caused to Fly Creek from construction of the shopping center, has been done. There is no plan in place to prevent further damage to Fly Creek.
